INTRODUCTION

As an archipelagic State, Indonesia which lies between the Indian and Pacific Oceans, and the other, between the Asian and Australian continents, is of strategic importance and holds an important position in oceans affairs.

The Indonesian struggle to gain international recognition for its territorial sovereignty as an archipelagic State trough the international forum, particularly through the Third United Nations Conference on the Law of the Sea, has been successfully carried out with the acceptance and inclusion of the archipelagic State principles in 1982 Convention on the Law of the Sea. With this recognition by the international community, Indonesian is aware of the heavy responsibility it faces to provide laws and regulations as an implementation of the Convention.

The problems of the implementation and interpretation of the Convention for a developing country like Indonesia will not be achieve effectively without recourse to sophisticated modes of legal and institutional research. One of the characteristics of the developing nations is the role and active participation of their universities, scholars and experts in their national development.

It is against this background, in 1985, the Consortium of Legal Sciences of the Ministry of Education and Culture, established an Indonesian Center for the Law of the Sea (ICLOS) at the Padjadjaran Law School, Bandung

The ICLOS has a three-fold functions, which are:

  1. Education/Training through two different programs of :
  1. short period courses of interdisciplinary training in the law of the sea and marine affairs which shall be geared toward the need to equip the practitioners, which could also operate as a workshop on certain properties, i.e. formulation of national or regional ocean policy, fisheries regulation and management, impact assessment of marine pollution in certain endangered area, etc;
  2. Post-graduate course which shall be built in into the existing post graduate programs in international law, as a step toward increasing the general educational and research capacity of the faculty members of the Indonesian Law School.
  1. Research though individual or group studies on the law of the sea and marine affairs. The ICLOS will provide opportunities for national or join research with institutions outside the country on subject relevant to the development of the (Indonesian) law of the sea and marine affairs.
  2. Forum of information exchange through :
  1. sponsorship of workshop and conferences
  2. Facilitating access to law of the sea and marine affairs literature and documentation.

OBJECTIVES

The main objectives of ICLOS are:

  1. to establish a service and management system for the teaching and research of on the law of the sea and marine affairs;
  2. to enhance interdisciplinary relation and nurturing institutional cooperation between universities, government agencies and other institutions dealing with the law of the sea and marine affairs;
  3. to develop a program and improvement of the facilities for educational and research ;
  4. to improve the curriculum on the law of the sea and the upgrading of the legal know-how of lawyers and the academic staff;
  5. to improve the facilities for research and research capabilities of the academic staff, legal practitioner and other experts on the law of the sea and marine affairs, both in national, regional and international scope;
  6. to provide educational and research facilities for the dissemination of legal and technical data of the archipelagic State regime through the educational and other institutions in Indonesia

THE PROJECT

In this workplan the ICLOS will carry out project activities that include :

  1. The training of specialist on the law of the sea and marine affairs.

In its first stage training shall be centered on a short term, non-degree program for the teaching staff, government officials and other practitioners to enable them to be equipped with the adequate knowledge on the law of the sea. In 1987, a plan for a three weeks training relations on the International Economic Law and Law of the Sea, had been executed as a cooperative effort of the Center and Netherlands Institute for the Law of the Sea (NILOS) and Netherlands Institute for Social and Economic Law Research (NISER) the University of Utrecht, the Netherlands

  1. Joint and independent research projects of the law of the sea and marine affairs of a special concern to Indonesia. In its initial stage the projects will be centered around :

compilation of list of experts, institutions and sources an the Law of the Sea and Marine affairs;

establishment of a standard minimum library on the Law of the Sea for the law school entrusted with educational programs for such matter;

compilation of national, foreign and international court decisions relating to Indonesia with special emphasis to court decisions relating to law of the sea

  1. Acquisition of Library resources

Acquisition of books, documents and other materials to meet the standard adequate for a minimum library of the Law of the Sea.
